$18.3 Million Verdict in Medical Malpractice Wrongful Death Case

We’re proud to share that Brooks Law Partners played a key role in securing an $18.3 million verdict for the family of a Georgia man who died of a heart attack in 2019 following non-emergency colon surgery. Our firm was honored to be brought in by the Bell Law Firm, with our founder, Natanya Brooks, leading the direct examination of the damages witnesses.

This case was tried in Gwinnett County State Court and resulted in a jury verdict holding two physicians accountable: our client’s cardiologist, and the surgeon who performed the colon procedure. The jury deliberated for four hours before finding 70% of the fault lay with the cardiologist and 30% with surgeon.

Over the course of several months, Natanya worked closely with our client’s family to prepare for trial. She met with each of the damages witness at least twice and guided them through practice sessions inside our firm’s mock courtroom, built at Brooks Law Partner’s headquarters to help clients and witnesses prepare for the courtroom experience. She got to know the family personally and understood what this loss truly meant to them.

The six-day trial culminated in an emotional and hard-fought win for the family, with the jury awarding $12 million for pain and suffering as part of the total verdict. The courtroom strategy involved anticipating and responding to the defenses offered by both sets of defense attorneys, each representing different physicians. Both defense teams contended that the care provided was within the standard and that no additional cardiac clearance was required, despite clear evidence that key warning signs had been missed.
